On October 28, 2005 Chapter 122 of the Acts of 2005 changed the drunk driving laws and penalties in Massachusetts If you refused a breathalyzer test and you have one prior offense conviction or program participation for OUI you will incur a license suspension of 3 years - two priors 5 years - three priors is LIFETIME - THESE PENALTIES ARE FOR A REFUSAL! You have only 15 days from the date of your arrest to appeal the refusal to the RMV. It can be successfully challenged - I have over 15 years of RMV appellate experience. As of January 1, 2006 all OUI hardship licenses for subsequent offender suspensions will require an ignition interlock device for the duration of the suspension plus an additional 2 years after the end of the suspension.
