On October 28, 2005 Chapter 122 of the Acts of 2005 changed the drunk driving laws and penalties in Massachusetts
If you refused a breathalyzer test and you have one prior offense conviction or program participation for OUI you will incur a license suspension of 3 years - two priors 5 years - three priors is LIFETIME - THESE PENALTIES ARE FOR A REFUSAL!
You have only 15 days from the date of your arrest to appeal the refusal to the RMV. It can be successfully challenged - I have over 15 years of RMV appellate experience. Timing is key in order to preserve your right to appeal. Call me immediately for a free consultation at 781-659-4200.
As of January 1, 2006 all OUI hardship licenses for subsequent offender suspensions will require an ignition interlock device for the duration of the suspension plus an additional 2 years after the end of the suspension.
