1. There was operation of a motor vehicle;
2. The operation was on a public way as defined by Commonwealth v. Harte;
3. That the operator was impaired by the consumption of alcohol at the time of the alleged offense.
THIS IS FAR MORE DIFFICULT THAN WHAT YOU MAY HAVE BEEN LED TO BELIEVE!
